TERMS AND CONDITIONS
1. Acceptance of Terms
By booking an appointment, purchasing a service, or engaging with Como Wellness Co Pty
Ltd (“Como Wellness”, “we”, “us”, or “our”), you agree to be bound by these Terms and
Conditions.
These Terms apply to all services provided by Como Wellness, including but not limited to
mobile IV therapy, wellness consultations, doctor-led wellness programs, telehealth services,
pathology coordination, and associated wellness support services.
2. Medical Disclaimer
Como Wellness does not provide emergency medical services.
Any information provided by Como Wellness, its staff, contractors, nurses, or practitioners is
intended for general educational purposes only and is not a substitute for medical advice,
diagnosis, or treatment.
Clients should always consult their treating medical practitioner regarding any medical
condition or treatment.
In the event of a medical emergency, clients should contact emergency services immediately.
3. Eligibility for Services
Clients must:
• Be at least 18 years of age unless accompanied by a parent or legal guardian and
approved by the treating practitioner.
• Complete all required health screening, consent, and medical history forms honestly
and accurately.
• Disclose all relevant medical history, medications, allergies, diagnoses, and health
conditions.
• Notify Como Wellness of any changes to their health status that may affect treatment.
Como Wellness reserves the right to refuse or discontinue treatment where it is considered
unsafe, clinically inappropriate, or outside the scope of available services.
4. Doctor-Led Wellness Programs
Certain wellness programs offered through Como Wellness require assessment by an
independent Australian-registered medical practitioner.
Clients may be required to provide relevant medical records, pathology results, blood test
results, specialist reports, or other health information as requested by the treating practitioner
to assist with clinical assessment and treatment planning.
Approval for treatment is at the sole discretion of the prescribing practitioner following
review of the client’s medical history, health status, and any supporting investigations deemed
necessary.
Como Wellness does not guarantee that a prescription, treatment plan, referral, or
recommendation will be issued following a consultation.
All clinical assessments, prescribing decisions, requests for pathology testing, referrals, and
treatment recommendations remain the sole responsibility of the treating medical practitioner.
5. Mobile IV Therapy Services
All IV therapy treatments are administered by appropriately qualified healthcare
professionals operating within their professional scope of practice.
Prior to treatment, clients may be required to complete a health assessment, provide relevant
health information, and sign an informed consent form.
Como Wellness reserves the right to decline treatment if a client is deemed unsuitable or if
treatment presents a clinical risk.
Treatments may be delayed, modified, or declined based on practitioner recommendations or
safety concerns.
6. Risks and Consent
By participating in any service provided by Como Wellness, clients acknowledge that all
medical and wellness treatments carry inherent risks.
Potential risks may include, but are not limited to:
• Bruising
• Swelling
• Pain or discomfort at the treatment site
• Bleeding• Infection
• Allergic reaction
• Headache
• Nausea
• Dizziness
• Fainting
• Fatigue
• Adverse reactions to prescribed treatments
• Other unforeseen complications
Clients acknowledge that individual results vary and no guarantee is made regarding
outcomes, effectiveness, or suitability of any treatment.
7. Appointments and Cancellations
Appointments may be rescheduled with a minimum of 24 hours’ notice.
Cancellations made with less than 24 hours’ notice may incur a cancellation fee.
Failure to attend a scheduled appointment without notice may result in forfeiture of
consultation fees, deposits, or prepaid services.
Como Wellness reserves the right to reschedule appointments due to practitioner availability,
unforeseen circumstances, safety concerns, or operational requirements.
8. Payments and Refunds
Payment is required prior to treatment unless otherwise agreed in writing.
Consultation fees are non-refundable once a consultation has taken place.
Prescription medications, compounded medications, pharmacy-dispensed products, and
customised treatment plans cannot be returned or refunded unless required by Australian
Consumer Law.
Refund requests will be assessed on a case-by-case basis in accordance with Australian
Consumer Law.
9. Pathology and Third-Party Providers
Where pathology testing, specialist referrals, pharmacy services, or other third-party
healthcare services are required, Como Wellness acts solely as a coordinator or facilitator.Pathology providers, pharmacies, medical practitioners, and other healthcare providers
operate independently of Como Wellness and are responsible for the services they provide.
Como Wellness accepts no responsibility for delays, errors, availability, or outcomes relating
to third-party services.
10. Privacy and Confidentiality
Como Wellness is committed to protecting client privacy and confidentiality.
Personal and health information may be collected, stored, and shared with healthcare
practitioners, pharmacies, pathology providers, and other healthcare providers where
reasonably necessary to deliver services.
Information will be handled in accordance with applicable Australian privacy legislation.
By engaging our services, clients consent to the collection, use, and disclosure of information
required to facilitate their care.
11. Limitation of Liability
To the maximum extent permitted by law, Como Wellness Co Pty Ltd, its directors,
employees, contractors, nurses, practitioners, and representatives shall not be liable for any
indirect, incidental, consequential, special, or economic loss arising from the use of our
services.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights
that cannot be excluded under Australian Consumer Law.
12. Independent Practitioners and Contractors
Medical practitioners, registered nurses, allied health practitioners, wellness practitioners, and
contractors engaged by Como Wellness may operate as independent contractors.
Each practitioner remains solely responsible for:
• Their professional conduct.
• Their clinical decision-making.
• Maintaining all relevant qualifications and registrations.
• Maintaining professional indemnity and other required insurance.
13. Retail Products and Wellness Goods
From time to time, Como Wellness may offer wellness products, recovery products,
supplements, and other health-related goods.
Such products are intended to support general wellbeing and are not intended to diagnose,
treat, cure, or prevent disease unless specifically approved and permitted by Australian law.
Clients should consult their healthcare practitioner before commencing any new supplement
or wellness product.
14. Intellectual Property
All branding, logos, educational materials, content, documents, website content, marketing
materials, and intellectual property remain the property of Como Wellness Co Pty Ltd unless
otherwise stated.
No material may be reproduced, copied, distributed, or used without prior written consent.
15. Amendments
Como Wellness reserves the right to amend these Terms and Conditions at any time.
Updated Terms and Conditions become effective upon publication on our website, client
portal, booking system, or other communication channels.
16. Governing Law
These Terms and Conditions are governed by the laws of Australia and the relevant state or
territory in which services are provided.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the
courts of Australia.
